Is it possible to make a claim for psychological injuries after an accident = YES

Aug 29, 2017

Depression, stress, anxiety, mood disorders and other psychological injuries have been recognised as injuries for which you can be compensated if you have suffered from them as a result of your accident.

However, to recover compensation for psychological injuries you will have to obtain an expert report which proves that you are suffering from that injury and that the injury was caused by someone else’s negligence.

The definition of personal injury extends to pschyological and emotional injury as well as physical injury. This means you can make a personal injury claim if you suffer emotional and/or mental injury as a result of another party’s negligence. Since a mental health problem is a very different thing from a broken leg, it’s necessary to clarify it by obtaining a report from an expert in this field.

The Injuries Board will not assess claims for psychological injuries and these types of cases will have to be assessed by a court if a settlement cannot be reached with the responsible parties.

It’s quite common to suffer physical and psychological injuries from an accident.
